Heard learned counsels for the parties.

The petitioner is in custody for more than 100 days and prays for bail.

Learned counsel for the petitioner submits that the victim lady refused medical examination. Charge sheet has been submitted. Further detention of the petitioner is not required.

Learned counsel for the State opposes the prayer. I have considered the material on record. Statement of the de facto complainant recorded under Section 180 of BNSS and statement of the victim lady recorded under Section 183 of the BNSS implicate the petitioner. The incident occurred behind a hospital where the victim lady had gone. Charge sheet has been submitted. The vulnerable witnesses are yet to be examined. In the event

the petitioner is released on bail at this stage possibility of winning over/influencing the witnesses cannot be ruled out. Accordingly, prayer for bail is rejected at this stage. The application for bail is thus disposed of. Case diary be returned.
