In Re: An application under Section 401 read with Section 482 of the Code of Criminal Procedure.

Sourav @ Souraav Kumar Bera

Versus

State of West Bengal & Anr.

Mr. Somnath Roy Chowdhury.

...for the petitioner.

Learned advocate for the petitioner is present. Records of the revisional application reflect that the matter appeared on 17th July, 2012, 2nd August, 2012 and 4th October, 2012 and the revisional application is yet to be admitted. The subject-matter of the revisional application relates to an order dated 2nd February, 2012 passed by the learned Judicial Magistrate, 1st Court, Howrah in connection with Complaint Case No. 1155C of 2008 under the Sections 449/323/354/506/34 of the Indian Penal Code.

I have perused the order passed by the learned Magistrate and I find that the reasons which have been assigned for dismissal in respect of the contention advanced by the petitioner are reasonable and adhering to the principles of law. As such, no interference is called for.

Accordingly, CRR 1825 of 2012 is dismissed.

Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
