This is an application for anticipatory bail filed in connection with Nandigram P.S. Case No.953 of 2024 dated 24.11.2024 under Sections 137(2)/140(3)/3(5) of the Indian Penal Code.

2. Heard the learned advocate representing the petitioner as well as the State.

The materials on record reveal the victim to have been recovered and her statement under Section 183 of the BNSS suggested approval on her part and innocence on the part of the petitioner. The charge-sheet in the instant case has been submitted on 30.04.2025. The victim has refused to be medically examined. Considering the facts and circumstances of the case, custodial interrogation of the petitioner is not necessary and he may be granted anticipatory bail however, subject to conditions.

Accordingly, it is directed that in the event of arrest, the petitioner, namely, Surajit Das be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer and also subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and on further condition that the petitioner shall cooperate with investigation and shall not intimidate witnesses or tamper with evidence in any manner whatsoever. The petitioner shall meet the Officer-in-Charge of the concerned police station once in a month until further orders.
