Versus

Gouri Basu In Re: An application under Section 482 of the Code of Criminal Procedure, 1973 The revisional application was preferred challenging the proceedings being Complaint Case No. 2133 of 2001 under Section 323/504/506 of the Indian Penal Code then pending before the Learned Chief Judicial Magistrate, 10th Court, Alipore.

Perused the earlier orders passed by a Co-ordinate Bench of this Court and I find that reports were called for from the Learned Magistrate and the Learned Magistrate has complied with the same.

Having regard to the fact that in the year 2012 only two witnesses were cited except a G.D and the petitioner approached this Court at the stage when cross-examination

of PW2 was proceeding, I am of the view that interference with the merits of the matter is unwarranted at such advanced stage of trial.

Accordingly, CRR 1830 of 2012 is dismissed.

Pending application, if any, is consequently disposed of.

Interim order, if any, is hereby vacated.
