Heard learned counsels for the parties.

Learned counsel for the petitioner submits that the petitioner is in custody for four months. He has not been named as the principal assailant. Statement of witnesses records that he dealt a single blow on the victim. He prays for bail.

Learned counsels for the State and the de facto complainant oppose the prayer and submit that 5 co accused are still absconding. The accused persons including the petitioner have been threatening the witnesses for which the de facto complainant was constrained to file a writ petition before the appropriate Bench.

I have considered the material on record. Injured eye witnesses to the incident have named the petitioner as one of the assailants. The offending weapon has been recovered at the instance of the petitioner. Vulnerable witnesses are yet to be examined.

Considering the material on record and prima facie involvement of the petitioner in the alleged offence, prayer for bail is rejected at this stage.

The application for bail is thus disposed of. Case diary be returned.
