The petitioner has challenged the proceedings arising out of Khardah Police Station Case No.285 of 2022 dated 17.04.2022.
The petitioner is directed to serve a copy upon Ms. Ratna Ghosh, learned advocate who ordinarily appears on behalf of the State, and is directed to represent the State. Her appearance may be regularised by the concerned authorities.
The investigation in this case commenced on 17.04.2022.
Mr. Mahapatra, learned advocate for the petitioner submits that the ingredients of Section 498A of IPC are lacking in the letter of complaint which has been treated as the FIR of the instant case and in spite of same the police authorities registered the case. The investigation is continuing for more than a year, this Court restrains from commenting on the contents of the letter of complaint. The investigating authority would assess in all fairness whether
a case under Section 498A of IPC is made out while submitting their report under Section 173 Cr.P.C. The petitioner would be at liberty at a subsequent stage to approach this court in case the report under Section 173 Cr.P.C. implicates him.
With the aforesaid observations, CRR 1926 of 2023 is disposed of.
Pending application, if any, is consequently disposed of.
