Learned advocate appearing for the petitioner submits that allegedly for recovery of 301 grams of brown sugar the petitioner has been implicated in connection with the instant case and he is in custody for more than 1 year 6 months. There has been no progress in the trial of the case in spite of the charge having been framed, as such, the petitioner may be released on bail. Learned advocate for the State, on the other hand, submits that out of 9 witnesses proposed to be examined, 4 witnesses have already been examined by the prosecution. Having considered the nature of progress in the trial and the fact that commercial quantity of contraband was seized from the possession of the petitioner, I am not inclined to release the petitioner on bail.

Accordingly, CRM (NDPS) 654 of 2025 is dismissed at this stage.

Learned advocate for the State would inform the learned public prosecutor regarding the production of the witnesses on the date fixed by the learned trial court so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. Report so submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
