APP Ms. Jonaki Saha ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner has been unnecessarily detained without any effort from the prosecution to take the case to its logical conclusion.

Learned advocate further submits that the evidence of the case is in progress. However, till date, there has been no effort to produce any witness before the learned Special Court concerned.

Learned advocate for the State submits that 728 gm of brown sugar was recovered from the possession of the petitioner.

Having considered the quantum of recovery, I am of the view that the rigours of 37 of the NDPS Act have been attracted, as such, I am not inclined to enlarge him on bail.

Hence, the prayer for bail of the petitioner is Rejected.

However, State is directed to expedite the process of trial and at least complete seizure list witnesses within a period of four months from the next date so fixed before the learned trial court.

Accordingly, CRM(NDPS) 653 of 2025 is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
