Kausik (Rejected) CRM (NDPS) 656 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with English Bazar Police Station Case No. 1725 of 2024 dated 22.11.2024 under Sections 21(c)/29 of the NDPS Act, 1985;

Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 1 year and there has been hardly any progress in the trial of the case. Learned advocate for the State submits charge has already been framed and the quantum of contraband recovered is 487 gms of Brown Sugar.

Having considered the materials in the case diary, I am of the opinion that rigors of Section 37 of the NDPS Act is attracted.

Consequently, the prayer for bail of the petitioner is rejected.

Accordingly, CRM (NDPS) 656 of 2025 is dismissed.

Learned Trial Court is directed to expedite the process of the trial in view of the detention of the petitioner. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
