This is an application for anticipatory bail filed in connection with Halisahar P.S. Case No.189 of 2025 dated 24.05.2025 under Sections 126(2)/115(2)/117(2)/109/303(2)/351(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023 read with Section 25 of the Arms Act.

Heard the submissions of the learned advocate representing the petitioners, learned advocate representing the State as well as the de facto complainant.

The materials on record revealed dispute between the petitioners as well as the de facto complainant over rehabilitation of Shiva Temple wherein both the parties engaged into a fight amongst each other
resulting in injuries to have been inflicted on each other. The nature of dispute between the parties does not require custodial interrogation of the petitioners and they may be granted anticipatory bail however, subject to conditions. 4.
Accordingly, it is directed that in the event of arrest, the petitioners, namely, (1) Rupak Mitra, (2) Subhas Sarkar, (3) Santu Dey and (4) Bimlesh Tiwari be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten thousand only) each, with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer and also subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and on further condition that the petitioners shall cooperate with investigation and shall not intimidate witnesses or tamper with evidence in any manner whatsoever. The petitioners shall meet the Officer-in-Charge of the concerned police station once in a month until further orders.
