Mr. Kaustav Ch. Das ... For the petitioner. The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite party, as such, service of notice of the present application upon the said opposite party is dispensed with.

The petitioner's suit for eviction of licensee was decreed on contest. The said decree is under challenge in the connected Ejectment Appeal No. 41 of 2019 pending before the learned District Judge at Alipore, District - 24 Parganas (South).

The petitioner complains inordinate delay in disposal of the said appeal and is praying a direction upon the Appeal Court below for expeditious disposal of it.

In view of the nature of the decree under challenge, the appeal is required to be disposed of expeditiously. The learned appeal Court below, therefore is requested to expedite the disposal of the said appeal and in doing so, shall not grant any unnecessary adjournment to either of the parties.

C.O. 1718 of 2022 is disposed of with the above terms without any order as to costs.
