19.06.2024 Item no.66.

Court No.28.

S. De (Rejected) CRM (DB) No. 1554 of 2024 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure.

And In the matter of : Gulshan Begum @ Disha.

......Petitioner.

Mr. Satadhu Lahirik ......for the Petitioner.

Mr. Suman De, Ms. Ankita Paul, ...for the State.

The petitioner says that she is innocent. She has been falsely implicated. The only allegation against her is that in her house the principal accused ravished the victim girl. She is in custody for 190 days. There is no change of early conclusion of the trial. She should be released on bail.

We have seen the material in the case diary produced by the learned advocate for the State. The victim girl in her statement recorded under Section 164 Cr.P.C. vividly narrates the alleged incident which clearly implicates the petitioner. According to her, the petitioner orchestrated the entire incident. On an overall assessment of the material on record and the possible extent of complicity of the petitioner in the alleged offence, we are not inclined to enlarge the petitioner on bail, at this stage.

CRM (DB) 1554 of 2024 is dismissed.
