The petitioner has raised objection with regard to the grant of benefit under the Pradhan Mantri Awas Yojna (PMAY) mission in favour of the private respondents being the eleventh and twelfth respondents. Objection was filed before various officers of the Bidhannagar Municipal Corporation. Allegation is that the same has not been considered till date.

From the documents annexed to the writ petition, it appears that a communication from the Under Secretary to the Government of India, Ministry of Housing and Urban Affairs (HFA-V Division) dated January 30, 2024 addressed to the Principal Secretary, Department of Urban Development and Municipal Affairs, Government of West Bengal (Annexure P3, p.25) was made wherefrom it emerges that the Ministry has intimated the department that the implementation of the PMAYU mission is the responsibility of the concerned

State and that the State is required to take necessary steps in the matter.

In such facts and circumstances, the instant writ petition is disposed of by directing the Principal Secretary, Department of Urban Development and Municipal Affairs, Government of West Bengal or any officer authorized by him to take necessary steps to consider the objection filed by the petitioner in accordance with the scheme, after giving reasonable opportunity of hearing to all the necessary parties by passing a reasoned decision at the earliest but positively within a period of twelve weeks from the date of communication of this order.

Affidavit of service filed in Court be taken on record.

All parties are to act on the server copy of this order duly downloaded from the official website of this Court.

Certified copy of this order, if applied for, shall be made available to the parties.
