This is an application for anticipatory bail filed in connection with Naihati P.S. Case No.19 of 2025 dated 31.01.2025 under Sections 103(1)/61(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023 read with Sections 25/35 of the Arms Act.

The learned advocate representing the petitioners submitted the petitioners were not present at the place of occurrence on the relevant date and time and they had been falsely implicated in the instant criminal case and sought for an order of anticipatory bail to be granted, further addressing that the CCTV footage would not reveal their presence at the spot of the alleged incident. 3.

Learned advocate representing the State submitted there were two places of occurrence of the alleged incident which had been

continuous. Moreover, out of ten charge-sheeted persons, eight have been in custody and their prayer for bail was rejected by the District Court on earlier occasion. An order of proclamation had been issued against the present petitioners on 5th May, 2025 and date of attachment had been fixed on 3rd June, 2025. 4.

Though the charge-sheet in the instant case has been filed on 26.04.2025, the allegations against the present petitioners to have been involved in the alleged crime are grave and severe and accordingly, the prayer for anticipatory bail of the petitioners is rejected.
