Petitioner approached this court at a stage when he was dissatisfied with the investigation carried out by the local police station. By an order dated 13.06.2024 the Co-ordinate Bench was pleased to transfer the investigation of the said case to CID. Consequently, steps have been taken and it has been represented today by Mr. Samanta, learned advocate appearing on behalf of the State that the investigation has been concluded and charge sheet has been submitted before the jurisdictional court. Petitioner now claims that the stridhan properties are yet to be recovered.
Be that as it may, in view of the charge sheet being submitted before the jurisdictional court and there are other cases pending, petitioner would if he is aggrieved by the investigation, make an
appropriate application before the jurisdictional court which will deal with the issues in accordance with law. As the investigation in relation to Murshidabad PS Case No. 246/2024 has been concluded, I am of the view that further pendency of the writ petition before this court is unwarranted as statutory remedies are presently available before the petitioner.
The earlier order dated 13.06.2024 reflects that Murshidabad PS Case No. 695/2024 dated 10.04.2024 which was registered for investigation against the sisters of the deceased was stayed let the interim order passed therein be vacated. Police authorities would take the investigation of the said case to its logical conclusion.
With the aforesaid observations WPA 13580 of 2024 is disposed of.
