The petitioner is the Branch Manager of the State Bank of India, Bally Durgapur Branch.

Learned counsel for the petitioner submits that one Fazle Nabi Khan, a customer of the bank offered a government job for the petitioner's sister in lieu of consideration. During the process of obtaining the said job by the sister, the defacto complainant learnt about the same and wished to offer herself for the said job upon payment of consideration. The petitioner has no nexus with the alleged offence of luring aspiring candidates into government job in lieu of huge amount of money. The petitioner's sister who has also been duped of huge sum of money has lodged FIR

before the jurisdictional police station. The petitioner was called by the Investigating Officer by notice issued under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and responded to the said notice. She undertakes to cooperate in investigation and prays for anticipatory bail. Learned counsel for the State opposes the prayer. It appears that the petitioner's sister is also a victim to the alleged crime of luring aspiring candidates on assurance of providing government jobs in lieu of huge amount of money. No monetary transaction appears to have been made in favour of the petitioner and she is prima facie not a beneficiary to the transaction. Record reveals that she has cooperated in investigation.

Considering the material on record as well as extent of complicity of the petitioner in the alleged crime, this Court is inclined to grant anticipatory bail to the petitioner. Accordingly, in the event of arrest the petitioner Sananda Dhali be released on bail on furnishing bond of Rs.10,000/-(Rupees Ten Thousand only), with two sureties of like amount each, to the satisfaction of the arresting officer and subject to provision under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The petitioner shall appear before the jurisdictional Court and pray for regular bail within two weeks from date.

The application for anticipatory bail is, thus, disposed of.
