The present revisional application was preferred challenging the charge-sheet filed before the learned CJM, Burdwan in connection with Burdwan Women Police Station Case No.58 of 2015 dated 24.3.2015.
Records of the revisional application reflect that the petitioners approached this Court at a stage when the documents under Section 207 of the Code of Criminal Procedure upon which the prosecution intends to rely upon was yet to be served upon the petitioners. So far as the charge-sheet is concerned, the same is formal opinion of the investigating officer and I do not find any fault in the same. The merits of the case can only be considered after assessing the documents on which the prosecution intends to rely upon.
Mr. Chattopadhyay, learned advocate, appears on behalf
of the private opposite party no.2.
Ms. Debjani Sahu, learned advocate, appears on behalf of the State and submits that the last date was fixed before the jurisdictional court on 2nd March, 2022 for supply of copy and commitment.
Report submitted by the learned advocate for the State be kept with the record.
In view of the prayer advanced before this Court at a premature stage, I am of the opinion that no interference can be made at this stage.
Accordingly, the revisional application being CRR 1590 of 2017 is dismissed.
Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
The petitioners would be at liberty to address their grievances in course of trial.
