It appears that the writ petitioner had participated in an auction conducted by the Canara Bank under the provisions of the SARFAESI Act, 2002. The writ petitioner having been successful bidder and purchaser is stated to have made payments from time to time towards the sale consideration. The petitioner is aggrieved by the fact that the possession of the property purchased has not been handed over to him till date. In the alternative, the petitioner has requested for refund of the money paid which has also not been considered.

In that view of the matter, let the Branch Manager/Authorised Officer, Canara Bank, Suri Branch consider the representation of the writ petitioner dated 25th May, 2021 and dispose of the same in accordance with law. If the petitioner is aggrieved by any such communication of the bank as directed hereinabove, he may approach the concerned Debts Recovery Tribunal for appropriate relief.

With the aforesaid observations, the writ petition is disposed of.

There shall be no order as to costs.
