1. The petitioner made certain construction work for the West Bengal Pollution Control Board as per the work order issued by the Haldia Development Authority.
2. The petitioner alleges non-payment of the bills raised.
3. Learned advocate representing the West Bengal Pollution Control Board submits, upon instruction that, all payment in respect of the construction work has been forwarded to the Haldia Development Authority.
4. Learned advocate representing the Haldia Development Authority is yet to receive instruction.
5. As it appears that part payment of the petitioner has already been made and part security deposit has also been released in favour of the
petitioner, accordingly, the instant writ petition is disposed of by directing the Chief Executive Officer of the Haldia Development Authority to take into consideration the prayer made by the petitioner for releasing the balance payment in accordance with law after giving reasonable opportunity of hearing to all the necessary parties and by passing a reasoned order.
6. The amount that is found due and payable to the petitioner shall be disbursed without any delay as Haldia Development Authority has already received money in respect of the said construction work from the West Bengal Pollution Control Board.
7. Steps shall be taken in the matter at the earliest but positively within a period of twelve weeks from the date of communication of this order.
8. Learned advocate for the petitioner is directed to forward a copy of the representation dated 5th February 2024 along with all supporting documents to the aforesaid respondent at the time of communicating the order of this Court.
9. Instruction forwarded by the Member Secretary, West Bengal Pollution Control Board disclosing all correspondences between the West Bengal Pollution Control Bard and the Haldia Development Authority in connection with the subject work order be retained with the records.
10. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
