(in Virtual Mode) The matter has been put up on the prayer of the petitioner for clarification of order dated 25.07.2025 praying for a direction upon the ESI authorities to invest the amount already recovered by the ESI authorities with any nationalized bank, so that the amount which is substantial can accrue interest and, in case, the petitioners succeed in the appeal, they will be entitled to the amount alongwith the interest and will thus not suffer loss.

On hearing learned counsels for both the parties and considering the prayer of the petitioners, which this Court finds, is reasonable, the ESI authorities are directed to invest the total amount which has already been recovered from the petitioners and invest the same with a government/nationalized bank drawing the highest interest.

The amount alongwith the interest shall be subject to the final decision in the proceedings between the parties.

The writ application stands disposed of.

Pending applications, if any, also stands disposed of.

Interim order, if any, stands vacated.

There will be no order as to costs.

Urgent certified photostat copy of this order, if applied for, shall be given to the parties as expeditiously as possible on compliance of all necessary formalities.
