Mr. Allen Felix ...for the petitioner Mr. Biplab Guha Ms. Tuhina Parvin ....for the State Mr. Sanat Kumar Roy Mr. Baidurya Ghosal ....for the respondent No.4 The petitioner has approached this Court alleging that no action has been taken by the respondents/the State Transport Authority on the representations made by the petitioner against the renewal of permit in favour of the respondent no. 4.

It is submitted by Mr. Felix that the petitioner had initially approached the Civil Court by filing a suit being Title Suit No. 401 of 2021. However, the plaint in such suit has been rejected under Order 7 Rule 11(d) of the Code of Civil Procedure. Thereafter, the petitioner has approached this Court by filing this writ petition since several representations made by the petitioner against the alleged illegal grant of permit in favour of the respondent No. 4 went unheeded.

It is submitted that during pendency of the writ petition, the Secretary, Regional Transport Authority, Purba Bardhaman has taken a hearing on June 20, 2025 and both the petitioner as well as the private respondent, i.e. the respondent No. 4 were represented in the hearing. A copy of Memo No. 1253(2)/MV/PBDN dated June 17, 2025 handed up by Mr. Felix, learned advocate appearing for the petitioner is taken on record. Mr. Felix submits that the outcome of the hearing has not been communicated to the petitioner as yet. Mr. Roy, learned advocate appearing for the respondent No. 4 submits that the allegations of the petitioner against the respondent No. 4 are wholly unfounded.

In view of the fact that the Secretary, Regional Transport Authority has already heard the writ petitioner and the respondent No. 4 on June 20, 2025 as submitted by the parties, there is no reason to keep this writ petition pending any further.

WPA 12315 of 2025 stands disposed of with a direction on the Secretary, Regional Transport Authority, Purba Bardhaman to communicate the decision that the Secretary may have taken pursuant to the hearing held on June 20, 2025 to the parties within a week from the date of taking of such decision.

Mr. Guha, learned advocate appearing for the State-respondents files instructions forwarded to him by

the Regional Transport Authority, Bankura and the Deputy Superintendent of Police Traffic, Purba bardhaman, the same are taken on record.

There shall, however, be no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied as expeditiously as possible. (Om Narayan Rai , J.)
