Learned advocate appearing for the petitioner submits that the petitioner is in custody for about 45 days and petitioner is better placed than other accused viz. Jakir Molla @ Jakir Sk. @ Molla Jakir who has been granted bail by the learned Sessions Judge, Purba Bardhaman.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail in view of the antecedents which are reported against the present petitioner and also the investigation of the case is progressing. Having considered the period of detention of the present petitioner and also the fact that search and seizure in the present case is basically complete, I am inclined to

release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed.

Accordingly, the petitioner viz., Ahamed Shams Tabrij @ Arup Middya @ Ahamed Shams Tabrej @ Arup Medda shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Purba Bardhaman.

If on bail, the petitioner shall meet with the Investigating Officer of the case once in a week till chargesheet is submitted before the jurisdictional court. Report submitted by the learned advocate appearing for the State be kept with the record.

The application for bail, being CRM (M) 1456 of 2026, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
