Kausik (Allowed) CRM (NDPS) 1267 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Malda Town GRPS Case No. 88 of 2024 dated 10th December, 2024 under section 20(b)(ii)(C)/23/29 of the NDPS Act, 1985.

Learned advocate appearing for the petitioner submits that petitioner is in custody from 10th December, 2024 and in spite of repeated directions by this Court only 2 witnesses have been examined. One of the independent seizure list witness did not support the prosecution case, as such the petitioner may be released on bail.

Learned advocate for the State opposes the prayer for bail as there has been recovery of 125 Kgs. of Ganja which is of commercial quantity.

Having considered that 9 more witnesses are yet to be examined by the prosecution and for more than 1 and half

years petitioner is in custody, further one of the independent witness did not support the case and the trial of the present case is progressing slowly, I am inclined to release the petitioner on bail.

Accordingly, prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Pappu Kr. Singh @ Pappu Kumar Singh shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, Special Court (under NDPS Act), 5th Court at Berhampore, Murshidabad. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Murshidabad without the prior permission of the learned Special Court. Accordingly, CRM (NDPS) 1267 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
