Mr. Shibaji Kr. Das Ms. Deblina De Ms. Moitriye Das ....for the petitioner Mr. Mukesh Gupta ....for the State Learned counsel appearing on behalf of the petitioner submits as follows. The petitioners are members of the Saguna Gram Panchayat. After the change of Government in the State following the results the recent Assembly Elections, members and supporters of the erstwhile ruling political dispensation have been falsely implicated in cases. It is alleged in the F.I.R. that the petitioners had stolen pesticides, fertilizers and medicines and were transporting them for sale elsewhere. The articles were allegedly seized from an open field.

Learned counsel appearing on behalf of the State relies on the case diary and opposes the prayer for anticipatory bail. He refers to the statements of witnesses including those of the transporters who were allegedly transporting the materials at the instance of the accused. He also refers to the seizure list and the enquiry report.

Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected. Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
