Although the reasons so objected by the learned advocate appearing for the opposite parties/respondents cannot be ruled out, but having regard to the nature of the allegations and the reasons so assigned by the petitioner, I am of the opinion that the delay is justifiable in the background of the circumstances prevailing at the time when the judgment was delivered.

Accordingly, the period of delay in preferring the Special Leave is condoned. Thus, CRAN 1 of 2022 is allowed.

In Re: CRMSPL 34 of 2022.

Having regard to the reasons so assigned and the prayer for leave to prefer memorandum of appeal, the petitioner is granted

leave to prefer the memorandum of appeal within a period of 30 days from date.

Accordingly, CRMSPL 34 of 2022 is allowed.
