2025-11-19Hon'Ble Justice Ajay Kumar Gupta2 pages

19.11.2025 Court No.23 DL/Item No.-39 [Milan] WPA 10617 of 2010 Nirupama Saw (Saha) versus The State of West Bengal & Ors.

1. None appears on behalf of either of the parties. No accommodation is sought for.

2. None appeared on behalf of the petitioner on earlier occasion.

3. No affidavit-in-opposition and no affidavit-in-reply have been filed by the parties as yet.

4. This case is pending since 2010, almost 15 years have passed.

5. This writ petition has been filed by the writ petitioner seeking direction upon the respondents and/or men as agents or subordinates for each one of them to show cause as to why the petitioner should not be engaged as Accredited Social Health Activist (in short, "ASHA") of the concerned Health Sub-Center of Rajnagar Gram Panchayat under the Rajnagar Development Block, District - Birbhum from the panel prepared on the basis of interview held on 26th March, 2010.

6. Considering the nature of the prayer and long pendency of this case, this Court deems it fit to be

disposed of on merits since the petitioner prayed for appointment or engagement as ASHA of the concerned Health Sub-Center Rajnagar Gram Panchayat on the basis of panel prepared on 26th March, 2010, and such panel would not be definitely valid after expiry of 15 years.

7. Therefore, it seems that the writ petition has become infructuous.

8. In view of the above facts and circumstances, the writ petition being WPA 10617 of 2010 is thus disposed of.

9. Interim order, if any, stands vacated.

10. All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court without insisting upon production of a certified copy thereof.
