The petitioners contend that they had no business issues and in spite of the same because of the letter of complaint addressed to the Deputy Commissioner, Detective Department (Special), Lalbazar, a case being Posta Police Station DD (Detective Department), Kolkata Case No. 14 of 2024 dated 30.01.2024 has been registered for investigation. Learned advocate appearing for the petitioners submits that none of them were part of the company which has been made the subject-matter of the case. Learned advocate further submits that before the Commercial Court, proceedings are pending between the parties.

I find that the investigation has commenced in the month of January, 2024. There are allegations which may after submission of report under Section 173 of the Code of Criminal Procedure conclude whether an offence has been made out or not, but presently as the investigation of the case is under progress, I am not inclined to interfere with the investigation.

The petitioners are granted liberty to approach this Court after the report under Section 173 of the Code of

Criminal Procedure is filed before the appropriate jurisdictional court.

With the aforesaid observations, the revisional application being CRR 1994 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
