The petitioner is directed to serve a copy of this revisional application upon Ms. Sujata Das, learned advocate who ordinarily appears for the State. Her appointment may be regularised by the concerned authorities.

The learned advocate appearing for the petitioner submits that the petitioner was initially granted bail in the year 2018 with an observation that the injury which has been inflicted upon the victim is simple. Subsequently he was appearing, but unfortunately because of his non-appearance on 11.04.2022, warrant of arrest was issued against him. the said warrant of arrest is still pending.

Learned advocate for the petitioner undertakes that the petitioner would surrender before the jurisdictional court. In view of the undertaking given by the learned advocate for the petitioner, I direct that if the accused Sanjib Saha @ Munna appears before the jurisdictional court in connection with G.R. No. 2945 of 2018 arising out of Bhutni Police Station Case No. 70 of 2018 dated 11.07.2018, the

learned jurisdictional court will allow the petitioner to continue on the same bail and bond, but impose stringent conditions to ensure his appearance in future. The warrant of arrest so issued is stayed till 30.06.2023. Within the aforesaid date, the petitioner should comply with the undertaking.

If the petitioner does not surrender within the aforesaid date, on 01.07.2023, the learned jurisdictional court will revive the warrant of arrest earlier issued.

With the aforesaid observations, the revisional application being CRR 1940 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties including the learned Trial Court shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
