The petitioner complains that the private respondent, who was engaged by him for disposing of some properties, is demanding sums of money in extortion.

The petitioner has complained to the Officer-inChrage, Pandua Police Station and submits that there is inaction on the part of the police.

Learned counsel for the State has produced a report in the form of instructions dated 24th February 2022 issued by the Officer-in-Charge, Pandua Police Station addressed to the learned Government Pleader and the same is taken on record.

It appears from the instructions that the private respondent is only a commission agent and there are disputes and differences between the petitioner on the amount of commission payable to the private respondent.

This Court is of the view that such disputes are civil in nature and cannot be entertained by the police. However, since the petitioner complains that there is threat to his person and he is being prevented to visit his village at Pandua, the Officer-in-Charge, Pandua Police Station shall ensure that there is no breach of peace and the petitioner is properly escorted to his house at Pandua. In the event of any further threat or request from the petitioner, the Officer-in-Charge, Pandua Police Station shall take appropriate steps to protect the petitioner at the latter's costs. With the aforesaid observations, the writ petition is disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
