The petitioner is apprehensive regarding the warrant of arrest issued on 02.04.2024 as he expects that once he appears before the learned Special Court, he may be taken into custody in view of the warrant of arrest so issued. The petitioner was granted anticipatory bail by this Hon'ble Court on 29.08.2022 in C.R.M.(A) 4109 of 2022.

In view of the undertaking given by the learned advocate appearing for the petitioner before this Court, I direct that the petitioner shall make himself physically present before the learned Judge, Special 4th Court, Malda in connection with NDPS Case No. 90/2022 arising out of Baishnabnagar Police Station Case No. 550 of 2022 dated 25.06.2022 by 14.06.2024.

In case the petitioner appears before the learned Special Court, the learned Special Court will allow the petitioner to continue on the same bail, but will direct the petitioner to file afresh local surety which should be a title deed of a property of a person residing within the district of Malda. The warrant of arrest so issued be recalled after the petitioner appears before the court.

In case the petitioner do not appear before the learned Special Court by 14.06.2024, on the next working day, the learned Special Court would be at liberty to exhaust harsher process of law by adhering to Section 82 of the Code of Criminal Procedure.

With the aforesaid observations, the revisional application being CRR 1997 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
