1) Affidavit of service filed on behalf of the petitioner is taken on record.
2) Matter is taken up for consideration in presence of learned advocates representing the petitioner and State respondents.
3) Mr. Chatterjee, learned advocate representing the petitioner submits that petitioner is Vice-Chairman of Taki Municipality who could not discharge duty being Vice-Chairman of said Municipality after declaration of result of Assembly Election on 4th May, 2026. Prayer is made for granting protection to family members of the petitioner since it is apprehended that family members of the petitioner may be victims of post-poll violence at any time.
4) Mr. Das, learned Additional Government Pleader representing the State respondents has placed a communication dated 22nd June, 2026 of Inspector-inCharge, Hasnabad Police Station, Basirhat Police District and same is taken on record. Copy of said communication is made over to learned advocate representing the petitioner.
5) It is disclosed in communicated dated 22nd June, 2026 that two criminal prosecutions, one being Hasnabad Police Station Case No. 398/2026 dated 30th May, 2026 and another being Hasnabad Police Station Case No. 413/26 dated 3rd June, 2026 are subsisting against the petitioner and in connection with Hasnabad Police Station Case No. 398/2026 dated 30th May, 2026 notice under section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 was served but petitioner has not complied with such notice till date.
6) In view of contents of communication dated 22nd June, 2026, concerned police authorities are directed to investigate aforesaid cases in accordance with law and take those proceedings into logical conclusion at an early date by submitting reports before the jurisdictional Magistrate.
7) However, concerned police authorities are directed to maintain peace and tranquility in and around the premises of the petitioner where petitioner and his family members are staying.
8) Writ petition stands disposed of.
9) Urgent photostat certified copy of this order, if applied for be given to the parties on usual undertaking.
