Kausik (Rejected) CRM (NDPS) 664 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Bowbazar Police Station Case No. 40 of 2024 dated 16.03.2024 under Sections 21(c)/29 of the NDPS Act, 1985;

Learned advocate appearing for the petitioner submits that the petitioner is in custody for about 1 year and 9 months and in spite of earlier directions, there has been hardly any progress of the case. Only 2 witnesses out of the 8 witnesses have been examined.

Learned advocate for the State opposes the prayer for bail and submits that 2160 bottles of Cough Syrup were recovered from a godown and the petitioner is thickly connected with the said godown. The documents in this respect is available in the case diary.

Be that as it may, from the charge sheet I find that one Bikash Kr. Shaw happens to be a seizure witness.

Prosecution will examine Bikash Kr. Shaw after the examination of the scheduled witness is over on the next date. Let the witness of this Bikash Kr. Shaw be completed by 28.02.2026.

Petitioner will renew his prayer for bail after the evidence of Bikash Kr. Shaw is over.

However, CRM (NDPS) 664 of 2025 is dismissed at this stage.
