Mr. Supratim Dhar Mr. Suddhadev Adak ... for the State Affidavit-of-service, as filed, be kept on record. The present writ petition has been preferred primarily praying for expeditious disposal of the original application (hereinafter referred to as OA), being OA 445 of 2018 filed before the learned Tribunal.

Mr. Manna, learned advocate appearing for the petitioners submits that the matter pertains to inaction on the part of the respondent no. 3 towards disposal of a Misc. Case No. 65 of 2022 filed by the petitioners. The OA was heard by the learned Tribunal on 05.1.2024 and the next date has been fixed about eight months thereafter on 12.9.2024 and as such, there is no possibility towards early disposal of the OA.

It appears from the order impugned that the learned Tribunal has called for a status report from the said respondent no. 3 for effective disposal of the matter and has fixed the same on 12.9.2024.

This Court cannot issue any direction for speedy disposal unless there is a justification or acceptable reason for issuing any such direction.

In view thereof, the petitioners' prayer for expeditious disposal is refused.

However, Mr. Siddiqui, learned A.G.P. appearing for the State respondents submits that the status report, as called for would be filed before the learned Tribunal within six weeks from date.

Needless to observe, after the status report is filed, the learned Tribunal would take appropriate steps towards disposal of the OA on the returnable date or as expeditiously as possible thereafter, without granting any unnecessary adjournment to either of the parties.

With these observations and directions, the writ petition is disposed of.
