Apprehending arrest in connection with Bauria Police Station Case No.114 dated 02.06.2018 under Sections 448/436/427/506 of the Indian Penal Code, 1860, the present application has been preferred.

The learned advocate appearing for the petitioner submits that the petitioner has been falsely implicated. No overt act has been attributed to the petitioner. Upon completion of investigation charge sheet has also been submitted and as such, custodial interrogation is not necessary. The learned advocate appearing for the State opposes the petitioner's prayer and draws our attention to several documents in the case diary, including the seizure list. Heard the learned advocates and considered the materials in the case diary.

It appears that the petitioner has been absconding since the date of the alleged incident on 29th May, 2018. Considering the nature of allegations, the conduct of the petitioner and the extent of his complicity in the alleged offence, we are not

inclined to exercise any discretion in his favour. As such, his prayer for anticipatory bail is refused.

Accordingly, the application for anticipatory bail, being CRM No. 5589 of 2021 is dismissed.
