Birendra Nath Jana v. State Of West Bengal And ORS.
21st May, (AK) W.P.A 13665 of 2024 Birendra Nath Jana Vs.
The State of West Bengal and others Mr. Pappu Adhikari ...for the petitioner.
Mr. Mujibar Rahaman Ms. Chandramala Mukherjee ...for the State.
1.
The petitioner submits that the petitioner's deed, which was presented for registration, subsequently suffered an allegation that the stamp papers used were forged.
2.
For such reason, the petitioner is not being handed over the certified copy of the said document. 3.
Learned counsel appearing for the respondents/registering authorities hands over a statement of fact which indicates that the document could not be handed over since the stamp papers used were forged.
4.
However, in his usual fairness, learned counsel for the authorities also indicates that certified copies can be given only if the court passes a specific order in that regard.
5.
Since the petitioner is agreeable to deposit the money equivalent of the allegedly forged stamp papers, there cannot be any impediment in handing over a certified copy of the deed to the petitioner. 6.
Accordingly, WPA 13665 of 2024 is disposed of by directing the petitioner to deposit the money equivalent of the allegedly forged stamp papers on which the concerned deed was printed.
7.
Upon such deposit being made, the respondent authorities shall issue a certified copy of the document in favour of the petitioner, as expeditiously as possible, preferably within four weeks from such date.
8.
The instructions handed over in court today and the affidavit-of-service filed today be kept on record. 9.
There will be no order as to costs.
10. Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
