The learned advocate for the appellant submits that the complaint case was dismissed and the accused was acquitted for want of jurisdiction. The merit of the complaint case was not dealt with by the learned trial court.

The appellant has expired on 30.10.2023 as per the report filed by the S.I. of Burrabazar Police Station, dated 21.12.2023. The said report along with death certificate be kept on record. Under such circumstances, the instant appeal gets abated and accordingly disposed of. However, the legal heirs of the appellant are at liberty to take necessary steps for substitution before the learned trial court.
