Petitioner has filed this writ petition for relief of direction upon the electricity authority to provide electricity connection to the petitioner's premises in question.
Learned advocate appearing for the respondents electricity authority submits that the petitioner has not complied with the Clause 3.2.1(c) of Notification dated 31st May, 2010 issued by West Bengal Regulatory Commission and furthermore there is practical difficulty in providing electricity connection since cable will have to be laid over a third person's property and electricity authority is facing physical resistance from the third party which has already been communicated to the petitioner.
Considering the facts and circumstances of this case and submission of the parties this writ petition being WPA 12641 of 2023 is disposed of by granting liberty to the petitioner to approach the electricity authority concerned and convince them that through some other passage the connection can be provided since according to the petitioner occupier of the said other passage have got no objection. If petitioner satisfies the electricity authority the condition which is required to be fulfilled for getting electricity connection, the authority concerned shall provide the electricity after fresh visit and inspection of the premises in question and subject to compliance of all other legal formalities. Such exercise by the electricity authority shall be completed within eight weeks from the date of making fresh representation to the authority concerned. Petitioner will also be at liberty to approach the District Magistrate concerned for redressal of his grievance.
