It is alleged that an application for passport made by the petitioner for her minor child stood rejected. She petitioner prays for issuance of passport in his favour.

After hearing learned counsel for the parties, it appears that there is a proceeding pending before the learned trial court with regard to adoption and guardianship of the minor child. The biological father of the child is not willing to give his consent for issuing passport in favour of the child.

As the application of passport has been rejected a fresh application is required for issuance of the same.

Under such facts and circumstances, I dispose of the writ petition observing that it will be open for the petitioner to make appropriate application before the concerned authority for obtaining the passport. In the event any application is made, the same shall be considered in accordance with law.

It is made clear that the writ petition is considered only for the purpose of issuance of passport. The observations made in this order will have no bearing over any civil proceeding pending in between the petitioner and her husband in relation to the minor child.

All parties are to act on the server copy of this order duly downloaded from the official website of this court.

Certified copy of this order, if applied for, shall be made available to the parties.
