Heard learned counsels for the parties.

The petitioner is the owner of a mini bus bearing registration no.WB/67/6810 and has been granted permit for plying the vehicle in the route Bankura to Ranigunge. The petitioner intends to replace his vehicle by a new one bearing registration no.WB/67B/7410 and filed an application before the concerned authority in this regard on 27th February, 2023, which is yet to be considered. The petitioner prays for a direction upon the concerned authority to consider the application at the earliest. Learned counsel for the State respondents submits that the 3rd respondent be directed to consider the application in accordance with law.

In view of the above, the writ petition is disposed of directing the 3rd respondent to consider and dispose of the application submitted by the petitioner dated 27th

February, 2023 within a period of six weeks from the date of communication of this order upon affording reasonable opportunity of hearing to the petitioner, in accordance with law. The petitioner shall make over a copy of the application dated 27th February, 2023 to the 3rd respondent at the earliest.

The decision taken by the authority shall be communicated to the petitioner within a week thereof. With the above observations and directions this writ petition being WPA 10642 of 2023 is disposed of. However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
