The petitioner complains that his father had a sum of money lying with the bank account maintained with Bangiya Gramin Vikash Bank. The said amount was withdrawn in instalments and the petitioner has been deprived of the same. To that effect, the petitioner informed to the concerned police station, but no steps have been taken. State has submitted a report which reflects that subsequently a case was registered being Goalpokher Police Station Case No. 331/2023 dated 06.06.2023 and the investigation of the case is still under progress.

Since the case was instituted on June 2023 and more than one and a half years have passed, the learned CJM/ACJM in seisin of the case would

call for a report from the investigating agency regarding the progress of the investigation and peruse as well as ascertain regarding the efforts put in by the investigating agency. It is further directed that if the complainant is directed to furnish documents and he has till date not furnished the documents, he would cooperate with the investigating officer of the case.

With the aforesaid observations, the writ petition being WPA 12651 of 2023 is disposed of. There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
