This is an application for condonation of delay in filing the application for restoration. Grounds shown in the application is satisfactory and accordingly the delay in filing the restoration application, is condoned.
CRAN 2/2024 is accordingly disposed of.
RE : CRAN 1 of 2024 This is an application for recalling wherein the petitioner has prayed for recalling of the order dated 10.1.2019 by which this Court was pleased to dismiss the application being CRR 2011 of 2000.
Having heard the learned counsel appearing on behalf of the petitioner and also
considering the facts and circumstances of the case, the prayer for restoration is allowed.
CRR 2011 of 2000 is restored to its original file with original number.
CRAN 1 of 2024 is accordingly disposed of.
Re :CRR 2011 of 2000 Petitioner is directed to serve a notice of restoration upon the opposite party intimating next date of hearing and to file affidavit of service on the returnable date.
Let the matter appear on 19th December, 2024 under the heading "Contested Application". Learned counsel appearing on behalf of the petitioner prays for stay of execution of sentence and prays for bail.
Having considered the submissions of the learned counsel for the petitioner, let the order of conviction passed by the court below dated 12th March, 1996 be stayed till disposal of the revisional application.
Considering the nature of allegation and also considering the submissions made on behalf of the petitioner, the petitioner, Partha Ghosh
may find bail of Rs. 5,000/- with one registered surety of like amount who must be local subject to the satisfaction of learned Chief Judicial Magistrate, Kolkata.
