1. Heard learned Counsel for both the parties.

2. It is fairly submitted at the Bar that the petitioner has no nexus in the alleged offence. In this regard, the report submitted by Mr. Tapas Rajak, SI, Baishnabnagar P.S., Malda filed in Court today by Mr. Saibal Bapuli, learned Additional Public Prosecutor for the State be taken on record.

3. Regard being had to such facts and submissions, factum of permanent residence of the petitioner, it is directed that the petitioner shall be released on bail by the Arresting Officer in the event of his arrest on such terms and conditions as deemed just and proper in the facts and circumstances of the case in connection with Baishnabnagar P.S. case No. 145 of 2023 dated 06.03.2023.

6. Accordingly, the prayer for the anticipatory bail is allowed.
