Petitioner is aggrieved by the fact that there has been seizure in respect of the vehicle and the goods (coal, coke etc.), in connection with the Kulti Police Station case no. 179/23. The police authorities proceeded on the basis of information which was made available with them. To that effect a report has been submitted by the Mr.

Sen, learned Additional Government Pleader appearing on behalf of the State. The case was registered on 31st of March, 2023. The present report submitted by the State is of 7th of June, 2023.

Having regard to the fact that more than one and half years have passed since the initiation of the case and the Jurisdictional Criminal Court is in siesin of the issue, so far as the return of the vehicle and the goods are concerned, petitioner would be at liberty to take out an application before the Jurisdictional Court, provided the

same has already till date not been dealt with by the said Court.

With the aforesaid observations, WPA 12660 of 2023 is disposed of.

Report so submitted by the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
