Ms. Ambiya Khatun ...for the Petitioners Ms. Aishwariya Rajyashree Ms. Puja Sonkar ...for the State Mr. Jay Lala ....for the respondent no. 7 The petitioners sought a direction upon the Prescribed Authority to act in terms of Section 12 of the West Bengal Panchayat Act, 1973 and convene, hold and conclude the meeting for consideration of the motion of no confidence submitted against the Pradhan, Paranpur Gram Panchayat.

Learned counsel for the petitioners submits that in view of the date of hearing fixed by the Prescribed Authority on June 30, 2026 by a notice issued on June 16, 2026, the writ petition has become infructuous and the writ petitioners do not intend to proceed with the writ petition any further.

Opposing the prayer of the writ petitioners, learned counsel for the 7th respondent/ Pradhan submits that a writ petition filed by the Pradhan being WPA No. 12152 of 2026 is pending and withdrawal of the present writ

petition shall prejudicially affect the Pradhan in the other writ petition.

It appears from the order dated May 29, 2026 passed by a coordinate Bench of this Court in the writ petition filed by the Pradhan that the petitioner therein/ Pradhan challenged a notice dated May 19, 2026 under sub-rule (2) of Rule 5(b) of the West Bengal Panchayat (Constitution) Rules, 1975. This Court recorded that any steps taken in the meeting would abide the final result of the writ petition and the resolution arrived at by virtue of the said meeting would not be given effect to without leave of the Court.

This Court is informed that the notice dated May 19, 2026 was cancelled and a fresh notice issued on June 16, 2026. Therefore disposal of the present application shall in no manner prejudice the petitioner in the other application.

In view of the above, the writ petition is dismissed as infructuous.

There shall, however, be no order as to costs. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
