Singh ... for the State-respondent(s) Learned advocate for the petitioners submits that the accusations made in the FIR relate to an incident of 2021 and the subsequent incident of 5th June, 2026 is related to each other.
Learned advocate emphasizes that the accusations itself reflect that there is a tenor of political vendetta attached in the complaint itself and the petitioners have been implicated in the present case followed by arrest. Learned advocate for the State opposes the prayer for bail and has drawn the attention of the court to the injury report as well as the statement of the witnesses. Having considered the above, without commenting on the merits of the case and on perusal of the materials available in the case diary, I am of the view that further
custodial detention of the present petitioners is unwarranted.
Hence, the prayer for bail of the petitioners is Allowed.
Accordingly, the petitioners viz, Tapas Kumar Kundu and Shayamaprasannya Kundu shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only) each, with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned CJM/ACJM, Purba Bardhaman.
If on bail, the petitioners shall meet with the Investigating Officer of the case once in a fortnight as also as and when called for by the Investigating Officer till submission of the charge-sheet.
Accordingly, CRM (R) 59 of 2026 is allowed.
Memo of Evidence submitted by the State be kept with the record.
