Mr. Arnab Mukherjee .....For the Petitioner The revisional application was preferred challenging complaint Case No.C/6974/2009 pending before the Learned Metropolitan Magistrate, 17th Court, Calcutta under Section 138 of the N.I. Act, as also the order dated 13.02.2009 passed by the Learned Chief Metropolitan Magistrate, Kolkata taking cognizance of the offence. I have perused the contentions advanced in the revisional application and I find that primarily the petitioner has challenged the proceeding on questions of fact. No issues have been raised wherein the statutory compliance required under Section 138 of the N.I. Act has not been complied with.

Accordingly, I am of the opinion that if there be any grievance the petitioner would agitate such points at the appropriate stage of the trial and no interference is called for from this Court at this stage. Accordingly, CRR 2205 of 2009 is dismissed.

All pending connected applications, if any, are consequently disposed of.

Interim order, if any, is hereby vacated.
