Heard learned counsels appearing on behalf of the parties.

The petitioner was the highest bidder in e-auction for sand mining floated by the authority on November 12, 2018 despite which letter of intent was not granted in his favour. Subsequently the authorities floated another auction for a higher bid which was cancelled due to nonavailability of bidders. The petitioner submits that she is agreeable to pay higher bid money which has been enhanced by 10% of the earlier bid and is interested to get the sand mining block for mining operation. The petitioner submitted a representation in this regard before the concerned authority on 08.04.2022 which is yet to be disposed of. The petitioner prays for direction upon the authority to consider her representation at the earliest.

It is submitted on behalf of the State-respondents that the 4th respondent be directed to consider the representation in accordance with law.

In view of the above, the writ petition is disposed of directing the 4th respondent to consider and dispose of the representation dated 08.04.2022 of the petitioner within a period of six weeks from the date of communication of this order, after giving reasonable opportunity of hearing to all the interested parties including the petitioner, in accordance with law.

The decision taken by the authority shall be communicated to the petitioner within a week thereof. With the above observations and directions this writ petition is disposed of.

There shall be, however, no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
