None appears for the petitioner either physically or through virtual mode at the time of call. No accommodation has been prayed for either.
This is a writ petition of the year 2009 praying for mandamus directing the respondents to issue supply order in respect of 3640 bales of jute bags in terms of the order dated 4th May, 2009.
When the writ petition was moved on 29th May, 2009, an interim order was passed that the supply is to be made by the writ petitioner in terms of the order dated 4th May, 2009 and the period of supply is to be extended by another 15 days from 31st May, 2009 as agreed to by the writ petitioner and the respondents. It does not appear from the record that the said interim order was extended subsequently.
Order sheet reflects that the petitioner is not interested to move the instant writ petition and it appears that nothing survives to be decided in the instant writ petition.
Accordingly, the instant writ petition stands dismissed for default.
