The petitioner is the unmarried daughter of a deceased 'Group D' staff of a Higher Secondary school and is praying family pension as such.
Ms. Chakraborty, learned Advocate for the State respondents had submitted that the Directorate of Pension, Provident Fund and Group Insurance, Government of West Bengal, the respondent no.3 herein is unable to process the prayer of the petitioner for want of the 'No Objection Certificate' from the other heirs of the deceased employee.
Ms. Haldar, learned Advocate for the petitioner has brought the said certificate, a copy thereof is supplied to Ms. Chakraborty.
The petitioner is directed to submit the said document to the respondent no.3 and in the event all the relevant papers are found to be in order, the said respondent shall issue the necessary Pension Payment Order in favour of the petitioner.
The respondent no. 3 shall complete the entire exercise within three weeks from the date of submission of the aforementioned 'No Objection Certificate'.
WPA 12673 of 2023 is disposed of with the above terms without any order as to costs.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
