Petitioners complained that they have informed 26.06.2025 Court No. 35 Item No. 79.

Rakib the police station that the private respondents are depriving them of their property and with that end in view they are threatening and conspiring to kill the complainant as well as the petitioner no.2. In spite of informing the police authorities till date no steps have been taken and as such the petitioners have been compelled to approach this court.

State has submitted a report. Report reflects that the police authorities on receipt of information have already drawn up proceedings under Sections 126/135(3) of the BNSS.

Having considered the steps which have been taken by the police authorities, I direct the police authorities to continue their surveillance and ensure that no untoward incident results or the persons who are in possession in their respective occupation should not be thrown away or dispossessed without due process of law.

With the aforesaid observations WPA 12545 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

A copy of the report be handed over to learned advocate appearing for the petitioners.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
